Anders dan gezamenlijke technologie-initiatieven (GTI’s), die de vorm aannemen van gemeenschappelijke ondernemingen waarvan de Gemeenschap lid is en waaraan zij financiële bijdragen betaalt, moet een Consortium voor een Europese onderzoeksinfrastructuur (hierna „ERIC” genoemd) niet worden beschouwd als een door de gemeenschappen opgericht orgaan in de zin van artikel 185 van Verordening (EG, Euratom) nr. 1605/2002 van de Raad van 25 juni 2002 houdende het Financieel Reglement van toepassing op de algemene begroting van de Europese Gemeenschappen (het Financieel Reglement), maar wel als een juridische entiteit waarvan de Gemeenschap niet noodzakelijkerwijze lid is en waaraan zij geen financiële bijdragen betaalt in de zin van artikel 108, lid 2, onder f), van het Financieel Reglement.
In contrast to Joint Technology Initiatives (JTI) constituted as Joint Undertakings of which the Community is a member and to which it makes financial contributions, a European Research Infrastructure Consortium (hereinafter referred to as ‘ERIC’) should not be conceived as a Community body within the meaning of Article 185 of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (the Financial Regulation), but as a legal entity of which the Community is not necessarily a member and to which it does not make financial contributions within the meaning of Article 108(2)(f), of the Financial Regulation.

3. De leden van het consortium, met inbegrip van het CRL, sluiten een contract om hun onderlinge verhoudingen vast te stellen, met name op financieel gebied.
3. The members of the consortium, including the CRL, shall enter into a contract to define the relations between them, particularly in financial matters.

Mocht voortzetting van de indirecte werkzaamheid niet mogelijk zijn of door de deelnemers worden geweigerd en er daardoor voor de Gemeenschap een financieel nadeel ontstaan, dan kan de Commissie, onverminderd een claim op deelnemers die niet meer aan de indirecte werkzaamheid deelnemen, tenzij het consortium erin slaagt de in gebreke blijvende partner te identificeren en de Commissie hiervan binnen zes weken in kennis te stellen, de deelnemers binnen de grenzen van lid 2, tweede zin aansprakelijk stellen.
If continuation is impossible or rejected by the participants, thus creating a financial disadvantage for the Community, the Commission may, without prejudice to any claim on failing participants, unless the consortium has been able to identify the defaulting participant and to report that participant to the Commission within six weeks, make a claim on the participants within the limits of paragraph 2, second sentence.
